Acceptance of Terms
The services that Graphic Art Downloads provides to you are subject to the following Terms and Conditions. Graphic Art Downloads reserves the right to update the Terms and Conditions at any time without notice to you. Your use of the Graphic Art Downloads web site and services signifies that you agree to and are bound by these Terms and Conditions set forth in this document.

Description of Services
Graphic Art Downloads, offers for sale: downloadable, editable, professionally designed graphics.
“Graphics” includes but is not limited to original and/or modified graphics, images, designs, illustrations and digital files.
“You” means the purchaser of Graphics from us.
“We”,“us” and “our” means Graphic Art Downloads.

Pricing
Prices vary on each graphic & are subject to change without notice.

Permitted Uses
Once purchased you have the right to reproduce our graphics on your product(s) in any quantity for a 24-month period from the time of purchase.

You do not own the Intellectual property Rights.

You may use any Graphics purchased from the Graphic Art Downloads website including, but not limited to the following purposes:

    Screen Prints, digital prints and reproductions in any quantity for clothing lines or brands;
    Flash Animations, Routing and Laser Engraving, Publishing;
    Advertising and promotional collateral and printed materials;
    Online or electronic publications, including web pages

You may modify, or have a third party perform the modifications of any purchased Graphics to meet your specific requirements.

You may transfer files containing the Graphics to your clients or other third parties for the purpose of reproduction, provided that such parties shall have no further rights to use the Graphics.

You may keep your products on sale after the 24-month period from the time of purchase but you may not reproduce the purchased Graphics after that period.

It is the purchaser's responsibility to ensure the Graphics does not break local trademarks and copyright laws. This includes any words or elements. Graphic Art Downloads holds no responsibility for legal action taken against the purchaser breaching local laws.

Prohibited Uses
You may not provide a copy of Graphics, or any part thereof, to any person or legal entity or allow any person or legal entity to obtain access to the Graphics, or any part thereof, except as expressly permitted above. You must not use any of the Graphics including but not limited to the following manner:

  (a) resell, share with your friends, colleagues, give away, repackage, or redistribute any of Artwork in any way, for free.
  (b) make available the original source files for download or resale.
  (c) use any Artwork in a manner that may be considered to be pornographic, obscene, defamatory or libellous in nature;
  (d) use any Artwork in a manner which depicts a person in a potentially sensitive subject matter;
  (e) sub-license, sell, rent, lend, or otherwise distribute any Artwork;
  (f) post a copy of any Artwork on a network server or web server for use by other users; or
  (g) transfer the rights to any Artwork or accompanying materials, except as specifically provided for in these Terms and Conditions.


Intellectual Property Rights
All content included on this site, such as text, graphics, logos, button icons, images, digital downloads, data compilations, and software, is the property of Graphic Art Downloads or its content suppliers and protected by the Australian Copyright Act (Cth) 1968 and international copyright laws.

You should be aware that it is illegal to reproduce or distribute copyrighted material without the permission of the copyright owner. Only the copyright owner, or the owner's legal agent, can give you permission to copy, distribute, or publicly display protected material. You do not own the copyright when purchasing items from the Graphic Art Downloads website.

All purchased Graphics are under the copyright protection of Graphic Art Downloads. Purchased Graphics are potentially sold more than once after the 24 month period had passed from the time you purchased the Graphics. By completing a purchase, you accept that Graphic Art Downloads may re-list your purchased Graphics after the 24-month period had passed from the time you purchased the Graphics. You accept and understand that Graphic Art Downloads has the full discretion to decide how many times the Graphics are resold to the purchasing clientele.

Product Delivery
All Graphic Art Downloads Graphics are digital files delivered through the Graphic Art Downloads website via links provided to the client.
Graphic Art Downloads does not ship out physical goods such as CD’s or other form of storage media.
By purchasing a Graphic Art Downloads Graphics, you agree that your order will be processed automatically and:

  1. The download links will be active immediately for a period of 30 days.
  2. Graphic Art Downloads may refund any potentially fraudulent purchase.
  3. Graphic Art Downloads representatives may contact you to verify your order.

Your Account
Graphic Art Downloads shall not be responsible for ensuring the accuracy of information of your account and therefore shall not be held liable for any losses sustained as a result of the incorrect information provided. Graphic Art Downloads shall also not responsible for maintaining confidentiality and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

Warranties
Graphic Art Downloads warrants that it reasonably believes it has not infringed or misappropriated third party intellectual property rights in this jurisdiction or internationally.

Warranty Exclusions
Graphic Art Downloads will not be liable for infringements of patents, trademarks, copyrights, other proprietary and/or intellectual rights arising out of misrepresentation or negligence or any use of the Graphics by you.

Graphic Art Downloads warrants that those aspects of access to, or use of, the services provided which are within its exclusive control will be fit for reasonable performance. Graphic Art Downloads cannot warrant and shall not be liable for those aspects of access to, or use of the services provided over which Graphic Art Downloads does not have exclusive control. Graphic Art Downloads shall not be liable for the following including but not limited to:
Problems and/or losses arising from malfunction of telephone networks or lines; computer on-line systems; services or providers (including but not limited to internet service providers; application service providers and content delivery networks); computer equipment or software, viruses, bugs or software or hardware configurations; Internet or any website or any combination thereof;

              •    Damage to your system occasioned by use of the site; and

              •    Internet connection speed, access errors, interruptions of access and download quality of the images;

Graphic Art Downloads will not be liable for any business or legal decisions, actions or omissions taken by you based on your choice of Graphics and no representations made by Graphic Art Downloads about the market appeal or saleability of any products on which you may reproduce the Graphics.   

It is your responsibility to ensure that any of the above problems are rectified within 30 days and Graphic Art Downloads does not promise that it can or will extend the 30 day period for download of the Graphics.

Entire Agreement
These Terms and Conditions sets out the entire agreement and understanding between the parties and supersedes all prior agreements, understandings or arrangements (oral or written) in respect of the subject matter of these Terms and Conditions and these Terms and Conditions prevail to the extent of any inconsistencies with your order and terms you seek to impose in any order.

Refunds
Since Graphic Art Downloads Graphics are all digital files and there are no means of any actual goods being returned to Graphic Art Downloads with the guarantee that the delivered files have been destroyed, therefore all sales are considered to be final and non-refundable once the client has activated the download links.

Links to 3rd Party Sites
The links in this area will let you leave the Graphic Art Downloads website. The linked sites are not under the control of Graphic Art Downloads and Graphic Art Downloads is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. Graphic Art Downloads is not responsible for webcasting or any other form of transmission received from any linked site. Graphic Art Downloads is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement of the website by Graphic Art Downloads.
